Traditional Art makes reasonable efforts to ensure the proper functioning and accessibility of the Site. However, Traditional Art does not guarantee that the Site, its servers, functionalities, or content shall operate uninterruptedly, securely, or free from errors, delays, defects, viruses, or other harmful components.
The Seller reserves the right, at any time and without prior notice, to suspend, restrict, interrupt, modify, update, or temporarily discontinue all or part of the Site, including for maintenance, security, technical interventions, software updates, operational reasons, or circumstances beyond its reasonable control.
To the extent permitted by applicable law, Traditional Art shall not be liable for temporary interruptions, technical malfunctions, data loss, unauthorized access, cybersecurity incidents, software incompatibilities, or other technical events affecting the operation or availability of the Site.
Nothing in this Document shall exclude or limit any mandatory consumer rights or any liability which cannot be excluded or limited under applicable law.
2.B INTELLECTUAL PROPERTY RIGHTS
All content made available on the Site, including but not limited to text, photographs, product images, graphics, logos, trademarks, trade names, designs, visual identities, artistic elements, product descriptions, videos, audio materials, source code, databases, and any other materials or content published on the Site (collectively, the “Intellectual Property”) are protected by copyright, trademark, design, unfair competition, and other applicable intellectual property laws.
Unless otherwise expressly stated, all Intellectual Property displayed on the Site is owned by Traditional Art, its collaborators, licensors, artisans, or other rights holders and is protected under applicable Romanian, European Union, and international intellectual property legislation.
No User, Buyer, or third party shall acquire any ownership rights, licenses, or other rights in relation to the Intellectual Property solely by accessing or using the Site.
Without the prior written consent of Traditional Art, it is prohibited to:
- reproduce, distribute, publish, transmit, modify, adapt, display, sell, license, exploit, or create derivative works from any Intellectual Property;
- use product photographs, product descriptions, branding elements, or artistic designs for commercial purposes;
- copy or imitate the visual identity, artistic presentation, or handmade designs of the Products;
- use automated means to extract, scrape, reproduce, or collect content from the Site.
Any unauthorized use of the Intellectual Property may result in civil, administrative, or criminal liability under applicable law.
3. ORDER
By completing the Order, the Buyer agrees that all data provided by them, necessary for the purchase process, are correct, complete, and true as of the date of placing the Order.
The Buyer may place Orders on the Site by adding the desired Products to the shopping cart and then finalizing the Order by making the payment through one of the methods expressly indicated. Once added to the shopping cart, a Product is available for purchase to the extent that there is stock available for it. Adding a Product to the shopping cart, in the absence of the Order being finalized, does not entail the registration of an Order, nor does it imply the automatic reservation of the Product.
The Seller may cancel the Order placed by the Buyer, following prior notification to the Buyer, without any subsequent obligation of either party towards the other and without either party being able to claim damages from the other, in the following cases:
- non‑acceptance by the issuing bank of the Buyer’s card of the transaction, in the case of online payment;
- invalidation of the transaction by the card processor approved by Traditional Art, in the case of online payment;
- the data provided by the Buyer on the Site are incomplete and/or incorrect.
The Buyer, a natural person, has the right to withdraw from the Contract, respectively to return a Product, within 14 calendar days, without invoking any reason and without incurring any costs other than those of delivery. Thus, according to GEO no. 34/2014, the period for returning a Product expires within 14 days from the day on which the Buyer takes physical possession of the Product.
If the Buyer decides to withdraw from the Contract, they shall contact Traditional Art through one of the communication channels indicated in the Contact section of the Site.
If the Buyer, a natural person, requests withdrawal from the Contract within the legal withdrawal period, they must also return any gifts that accompanied the respective Product. If the Order has been paid, the seller will reimburse the amount within a maximum of 14 (fourteen) days from the date the Buyer informs the Seller of his or her decision to withdraw from the Contract.
The amount will be returned as follows:
for Orders paid by bank card - (including Apple Pay, AMEX, BANCONTACT GOOGLE PAY Visa Mastercard Maestro)- by refund to the account from which the payment was made or by generating a voucher with the value of the returned product;
for Orders paid cash on delivery - by returning the value of the product to the bank account sent by the customer or by generating a voucher with the value of the returned product.
for Orders paid with PayPal - by returning the amount in the PayPal account from which the payment was made
The Seller may postpone the reimbursement of the amount until receipt of the Products sold or until receipt of proof that they have been shipped, if they have not offered to recover the Products himself.
If the Product is returned in a condition in which it shows a decrease in value resulting from handling exceeding what is necessary to establish the nature, characteristics, and functioning of the Products (missing accessories, or the Product is damaged), the Seller reserves the right to request a fee to restore the Product to its original condition, as the case may be, or to cover the price difference resulting from the sale of the product as resealed. Alternatively, at the Buyer’s request, the Product will be reshipped, the delivery costs being borne by the Buyer.
Since, in the case of distance sales, the Buyer does not have the possibility to check the Products before concluding the contract, they have the right to withdraw from the Contract. For the same reason, the Buyer is allowed to test and check the Products they have purchased, to the extent necessary to establish the nature, characteristics and functioning of the Products.
In order to establish the nature, characteristics and functioning of the Products, the Buyer must handle and inspect them in the same way as they would be allowed to do so in a real physical store.
The Buyer is only responsible for any diminished value of the Products resulting from handling other than that necessary to determine the nature, characteristics and functioning of the Products.
If the Buyer exercises their right of withdrawal after having used the Products to an extent that exceeds the limit necessary to establish their nature, characteristics and functioning, the Buyer is responsible for any reduction in the value of the Products. Traditional Art recommends that, when exercising the right of withdrawal, the Buyer returns the Product in the original, undamaged packaging, protected by stretch plastic film or packed in a cardboard box (without labels stuck on it, and without cuts, tears, etc.) and together with all its accessories.
Returned Products showing signs of wear (stains, scratches, dents, cracks, bumps, etc.)may be subject to a proportional reduction in reimbursement corresponding to the objectively assessed decrease in value. The final value is established according to the value of the parts to be replaced and the reconditioning labor, or as the difference between the initial value of the new product and the resale value of the used product. Any decrease in the value of the Products resulting from handling other than that necessary to determine the nature, characteristics and functioning of the Products is the responsibility of the Buyer. For clarity, from the total price of the returned Products, the Seller will retain an amount of money representing the decrease in the value of the Products. The equivalent of the decrease fee will be communicated to the Buyer upon receipt of the returned Products.
In the event that a Product ordered by the Buyer cannot be delivered by the Seller, Traditional Art will inform the Buyer of this fact and will return the value of the Product to the Buyer’s account, within a maximum period of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed their intention to terminate the Contract.
4. ORDER REFUSAL AND CANCELLATION
The Seller reserves the right, where objectively necessary to protect the legitimate interests of Traditional Art, users, or third parties, and without incurring liability, to refuse, limit, suspend, or cancel any Order, including but not limited to the following situations:
- suspected fraud, abusive conduct, or unauthorized transactions;
- incomplete, inaccurate, misleading, or false information provided by the Buyer;
- repeated refusal of deliveries or abusive return behaviour;
- pricing, technical, software, stock, or typographical errors;
- unavailability of the ordered Products;
- circumstances suggesting unauthorized commercial resale activities;
- failure of payment authorization or transaction validation;
- force majeure events or circumstances beyond the reasonable control of Traditional Art;
- conduct reasonably considered abusive, fraudulent, unlawful, or harmful to the legitimate interests of Traditional Art;
Where an Order is cancelled after payment has been processed, the Buyer shall receive reimbursement of the amounts paid, in accordance with the applicable legal provisions.
4.A CUSTOM-MADE, MADE-TO-ORDER AND PERSONALIZED PRODUCTS
Certain Products offered on the Site may be manufactured according to the Buyer’s specifications, personalized, made-to-order, produced in custom dimensions, custom colours, or otherwise adapted to the Buyer’s individual requirements.
In accordance with the applicable consumer protection legislation, such Products may be exempt from the statutory right of withdrawal.
Where a Product falls within such legal exception, this information shall be clearly communicated to the Buyer before the Order is placed.
Unless otherwise expressly agreed in writing by Traditional Art, Orders for custom-made, made-to-order, or personalized sed Products may not be cancelled once production, preparation, or customization sation has commenced.
Nothing contained in this clause shall affect the Buyer’s mandatory rights relating to lack of conformity or defective Products under applicable law.

To the maximum extent permitted by applicable law, Traditional Art shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or in connection with the use of the Site, the inability to use the Site, the Products, the Orders, the contractual relationship between the parties, or any delay or failure in performance.
Without limitation, Traditional Art shall not be liable for:
- loss of profits;
- loss of business opportunity;
- loss of revenue;
- loss of anticipated savings;
- reputational harm;
- emotional distress;
- loss of data;
- interruption of business activities;
- delays caused by couriers, payment processors, hosting providers, telecommunications operators, customs authorities, or other third-party service providers;
- technical malfunctions or interruptions affecting the Site;
- events beyond the reasonable control of Traditional Art.
Nothing in this clause shall exclude or limit liability which cannot legally be excluded or limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, death, personal injury, or mandatory consumer rights.
Nothing in this Document shall exclude or limit any mandatory consumer rights or any liability which cannot be excluded or limited under applicable law.
8. Return Policy
Right of Return / Withdrawal
If the Buyer is a consumer, the Buyer has the right to withdraw from the distance contract within 14 days, without giving any reason, in accordance with applicable law. The withdrawal period expires after 14 days from the day on which the Buyer, or a third party other than the carrier and indicated by the Buyer, acquires physical possession of the Products.
In order to exercise the right of withdrawal, the Buyer must inform Traditional Art of the decision to withdraw by means of an unequivocal statement sent through the contact details made available on the website. The Buyer may use a return or withdrawal form, where such form is made available by Traditional Art, but this shall not be mandatory unless expressly required by law.
Return of the Products
Following the exercise of the right of withdrawal, the Buyer shall return the Products or hand them over to Traditional Art, or to a person authorized by Traditional Art to receive them, without undue delay and in any event no later than 14 days from the date on which the Buyer communicated the decision to withdraw from the contract. The deadline shall be deemed complied with if the Products are sent back before the expiry of that 14-day period.
The Buyer may choose either:
- to request collection of the return by courier, where such option is made available by Traditional Art; or
- to hand over the return to one of the partner post offices indicated by Traditional Art.
Unless Traditional Art expressly agrees otherwise, the direct cost of returning the Products shall be borne by the Buyer. This shall apply only to the extent that the Buyer was informed of this obligation before the conclusion of the contract.
Condition of Returned Products
The Products returned by the Buyer must be sent back in the same condition in which they were received, subject only to handling necessary to establish the nature, characteristics, and functioning of the Products. The Buyer shall return the Products, where applicable, with the original labels intact, together with all accessories, gifts, and documents delivered with the Products, including any warranty certificate issued by the manufacturer or distributor.
The Buyer is entitled to inspect and test the Products only to the extent that such inspection and testing would reasonably be permitted in a physical retail store. Any handling exceeding what is necessary for such inspection may result in a diminished value of the Products for which the Buyer may be held liable in accordance with applicable law.
Where the Products show signs of excessive handling or use exceeding what is necessary to establish the nature, characteristics, and functioning of the Products, the reimbursement may be proportionally reduced to reflect the objectively assessed diminished value of the Products, in accordance with applicable law, including, without limitation:
- wear exceeding normal inspection;
- scratches, chips, stains, tears, deformation, or other physical deterioration;
- damage caused by impacts, mechanical shocks, electrical shocks, moisture, improper storage, or improper care;
- removal, loss, or deterioration of accessories, gifts, labels, packaging elements, or accompanying documents;
- unauthorized interventions, repairs, alterations, or modifications.
Where the returned Products are damaged as a result of handling, cleaning, storage, or use contrary to the care instructions provided by Traditional Art, and such handling exceeds what is necessary to establish the nature, characteristics, and functioning of the Products, the Seller reserves the right to reduce the reimbursement by an amount corresponding to the proven decrease in value, to the extent permitted by applicable law.
Incorrect Return Packages
If the return package contains products other than those identified by the Buyer in the completed return request or otherwise communicated to Traditional Art, the Seller reserves the right to refuse acceptance of the package following verification by the courier or receiving point.
If a return package is accepted for logistical reasons and, upon inspection, it is found to contain products different from those declared by the Buyer, the Seller reserves the right to suspend the processing of the return until the situation is clarified. Any costs generated by the return of undeclared, incorrect, or non-corresponding products may be borne by the Buyer, to the extent permitted by applicable law.
Refunds
If the Buyer validly exercises the right of withdrawal, Traditional Art shall reimburse all payments received from the Buyer, including the standard delivery costs, without undue delay and in any event no later than 14 days from the date on which Traditional Art is informed of the Buyer’s decision to withdraw. However, Traditional Art may withhold reimbursement until it has received the Products back or until the Buyer has supplied evidence of having sent back the Products, whichever occurs first.
Traditional Art is not required to reimburse any supplementary costs resulting from the Buyer’s choice of a type of delivery other than the least expensive standard delivery method offered by Traditional Art.
Any reimbursement shall be made using the same means of payment as the Buyer used for the initial transaction, unless the Buyer has expressly agreed otherwise and provided that the Buyer does not incur any fees as a result of such reimbursement. Where cash reimbursement is not available outside Romania, Traditional Art may reimburse the Buyer by bank transfer or another non-cash payment method agreed with the Buyer, to the extent permitted by applicable law.
Non-returnable / limited return cases
The right of withdrawal shall not apply, or may be limited, in the cases provided by applicable law. If Traditional Art offers Products that fall under legal exceptions to the right of withdrawal, such exceptions shall be communicated separately and clearly before the Order is placed.
Return address
Unless otherwise communicated by Traditional Art in connection with a specific return request, returned Products shall be sent to the return address indicated below:

Legal Guarantee of Conformity
Consumers purchasing Products from www.traditionalart.store benefit from the legal guarantee of conformity provided by applicable consumer protection legislation. The Seller shall be liable for any lack of conformity which exists at the time the Products are delivered and which becomes apparent within two years of that time.
The Product shall be considered in conformity with the contract where it complies with the description, type, quantity, quality, and other characteristics provided for in the contract, is fit for the purposes for which Products of the same type would normally be used, and possesses the qualities and durability which may reasonably be expected, taking into account the nature of the Product and any public statements made by or on behalf of the Seller.
A lack of conformity may exist, in particular, where the Product:
- materially differs from the description, specifications, or images presented at the time of purchase;
- contains manufacturing, weaving, edging, or workmanship defects;
- presents structural defects affecting its normal or intended use;
- exhibits abnormal deterioration resulting from defective materials or production methods; or
- shows abnormal or excessive colour transfer resulting from a defective dyeing process.
Where a lack of conformity is established, the consumer shall be entitled to the remedies provided by applicable law. Depending on the circumstances and the conditions laid down by law, such remedies may include bringing the Product into conformity by repair or replacement, a proportionate reduction of the price, or termination of the contract.
Any lack of conformity which becomes apparent within one year of delivery shall be presumed to have existed at the time of delivery, unless proved otherwise or unless such presumption is incompatible with the nature of the Product or the nature of the lack of conformity. This provision shall apply without prejudice to any more favourable mandatory national rules.
Handmade and Natural Material Characteristics
The Buyer acknowledges and accepts that the Products are handmade and made from natural wool fibres. As a result, slight variations in size, weaving density, appearance, finish, texture, and colour, as well as slight pilling, softening, felting, or normal evolution of the fibres over time, may occur as inherent characteristics of the Product.
Such inherent and minor variations, insofar as they are consistent with the nature of handmade wool products and do not affect conformity with the contract, shall not in themselves constitute a defect or a lack of conformity.
PRODUCT APPEARANCE, COLOUR, AND HANDMADE CHARACTERISTICS
Traditional Art Products are handmade using traditional artisanal techniques and natural materials. Minor variations, artisanal marks, asymmetries, and differences in texture, finish, or colour are natural characteristics of authentic handmade craftsmanship and contribute to the uniqueness of each Product.
Minor asymmetries, irregularities, weaving variations, artisanal marks, hand-finishing differences, or slight variations in dimensions and colour tones are inherent characteristics of handmade artisanal products and contribute to their authenticity and uniqueness.
Traditional Art makes reasonable efforts to display as accurately as possible the colours, textures, dimensions, appearance, and characteristics of the Products presented on the Site.
However, due to:
- handmade manufacturing methods;
- the use of natural fibres, wool, dyes, wood, leather, textiles, or other natural materials;
- artisanal weaving, dyeing, carving, painting, or finishing techniques;
- lighting conditions during photography;
- monitor, browser, screen, or mobile device calibration differences;
- natural variations in materials;
certain variations in colour tone, texture, dimensions, finish, symmetry, appearance, or decorative details may exist between the Product photographs displayed on the Site and the Product delivered to the Buyer.
The Buyer acknowledges and accepts that such variations constitute normal and inherent characteristics of handmade artisanal products and shall not, in themselves, constitute defects or lack of conformity, provided that the Product substantially corresponds to its description and intended characteristics.
Due to the handmade nature of the Products, slight variations in dimensions, weaving density, texture, finishing details, and colour tones may naturally occur.
Circumstances Not Constituting Lack of Conformity
To the extent permitted by applicable law, the Seller shall not be liable under the legal guarantee for deterioration or damage resulting from causes occurring after delivery and not attributable to the Seller, including:
- normal wear and tear resulting from ordinary use;
- natural aging of wool fibres;
- minor pilling, felting, softening, or texture changes consistent with the nature of wool;
- aesthetic variations inherent in handmade products;
- improper use, negligent handling, improper cleaning, improper drying, or improper storage;
- exposure to moisture, mold, insects, pests, chemicals, fire, accidents, pets, or other external factors;
- excessive friction, sharp objects, heavy furniture, or unsuitable surfaces; or
- repairs, modifications, or alterations not carried out or authorized by the Seller.
This clause shall not exclude or limit any mandatory consumer rights that cannot be waived or restricted by contract.
Nothing in this Document shall exclude or limit any mandatory consumer rights or any liability which cannot be excluded or limited under applicable law.
Assessment of Claims
In order to assess a claim relating to an alleged lack of conformity, the Seller may request the consumer to provide relevant information and supporting documents, including proof of purchase, photographs of the reported issue, and information concerning the Product’s use, maintenance, cleaning, and storage.
Where necessary for the examination of the claim, the consumer may be requested to make the Product available to the Seller or to return it to the address indicated by the Seller for inspection.
Where the lack of conformity is confirmed and the Product must be repaired, replaced, or returned following termination of the contract, the applicable remedy shall be carried out free of charge to the consumer, including the necessary costs of postage, carriage, labour, and materials, in accordance with applicable law. The Seller may not impose on the consumer costs that are prohibited by the mandatory provisions governing the legal guarantee of conformity.
If, after assessment, the reported issue is found not to constitute a lack of conformity for which the Seller is liable under applicable law, the Seller may inform the consumer accordingly and, where appropriate, may indicate the conditions under which the Product may be returned to the consumer at the consumer’s expense.
Where the lack of conformity becomes apparent within one (1) year from delivery, it shall be presumed to have existed at the time of delivery, unless proven otherwise or unless such presumption is incompatible with the nature of the Products or the nature of the lack of conformity, without prejudice to any more favorable mandatory provisions of applicable national law.
Any remedy granted under the legal guarantee of conformity shall be provided free of charge to the consumer, in accordance with applicable law. Where required by law, this shall include the necessary costs incurred in bringing the Products into conformity, including postage, carriage, labor, and materials.
The consumer acknowledges and accepts that handmade and natural-fiber Products may present slight variations in dimension, texture, weaving density, appearance, finish, and color, as well as minor pilling, felting, or softening over time, consistent with the nature of the materials used and the handmade manufacturing process. Such characteristics shall not, in themselves, constitute a lack of conformity.
10. DECREASE IN VALUE OF RETURNED PRODUCTS
In the case of distance contracts, the Buyer is unable to physically inspect the Products prior to the conclusion of the contract. For this reason, the Buyer benefits from the right of withdrawal under the conditions established by applicable law.
The Buyer shall be entitled to handle and inspect the Products only to the extent necessary to establish their nature, characteristics, and functioning. Such handling and inspection shall be limited to what would reasonably be permitted in a physical retail environment.
The Buyer shall be liable for any diminished value of the Products resulting from handling, use, testing, or manipulation exceeding what is necessary to establish the nature, characteristics, and functioning of the Products. Any use of the Products beyond the limits of a normal in-store inspection shall entitle the Seller to reduce the amount to be reimbursed or, where appropriate and permitted by applicable law, to recover compensation corresponding to the decrease in value.
Without limitation, handling exceeding what is necessary may include:
-use of the Products for purposes other than inspection;
-prolonged or repeated use of the Products;
-use of the Products in conditions exposing them to dirt, moisture, odors, smoke, stains, pets, or other contaminants;
-deterioration caused by improper handling, storage, washing, cleaning, installation, or transport;
-removal, damage, or loss of packaging, labels, protective elements, accessories, or documents accompanying the Products, where such elements affect the resale value of the Products;
-any act or omission as a result of which the Products can no longer be offered for sale as new.
In the case of handmade, woven, or wool-based Products, the Buyer may inspect the Product by unfolding it, examining its dimensions, texture, weaving, colour, finish, and general appearance, in the same manner as would be reasonably possible in a physical store. However, placing the Product into actual use, exposing it to flooring wear, furniture pressure, moisture, household contaminants, or repeated handling beyond what is strictly necessary for inspection may constitute excessive handling and may result in a diminished value.
The Seller reserves the right to examine all returned Products upon receipt in order to determine whether the Products have been handled beyond the extent necessary to establish their nature, characteristics, and functioning. Any assessment of diminished value shall be made in good faith, on the basis of the condition of the Products at the time of return, and in accordance with applicable law.
Where the returned Products show signs of excessive handling, use, deterioration, or damage attributable to the Buyer, the Seller reserves the right to retain from the reimbursement due an amount corresponding to the proven decrease in value of the Products.
Where the Seller determines that the reported defect or damage results from improper care, handling, cleaning, storage, or use contrary to the care instructions provided, the claim may be rejected to the extent permitted by applicable law. In such case, the Product may be returned to the Buyer at the Buyer’s expense and without repair
If the Products returned following withdrawal show damage resulting from improper care, improper cleaning, improper storage, or other handling contrary to the care instructions communicated by Traditional Art, and such handling exceeds what is necessary for permitted inspection, the Seller may apply a corresponding reduction in the reimbursement due, to the extent permitted by applicable law.
Where the Seller has failed to provide the Buyer with the information on the right of withdrawal as required by applicable law, the Buyer shall not be liable for any diminished value of the Products resulting from handling, to the extent provided by law.
In the event that a Product ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Client/Buyer of this fact and will return the value of the Product to the Buyer's account, within a maximum period of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed their intention to terminate the Contract.
The availability of a Product will be displayed on the Site as follows:
In stock: The Product is currently available in stock.
Made to order: The Product is not currently in stock but may be produced upon request, subject to confirmation of availability, production time, specifications, and pricing.
Out of stock: The Product is currently unavailable.
